Lumos Learning uses student data for education-related purposes. Student identifiable data is never shared with any third parties without the consent of an authorized representative of the applicable school or district. Lumos Learning does not sell or share any student data nor use any student data for targeted advertising.

This Policy and Our privacy practices in pursuance thereof are consistent with the relevant means Federal, State, Local, and Municipal laws and regulations in the United States including but not limited to, State privacy laws of California, Virginia, Colorado, Utah and Connecticut, specifically for residents of these States, that relate to the privacy, data protection or data security of your Personally Identifiable Information. We are signatories to the Student Privacy Pledge, a voluntary standard but legally binding industry pledge to safeguard student privacy regarding the collection, maintenance, and use of student personal information.

By using this Website or any features thereof, you understand, acknowledge, and agree to the clause(s) and sub-clause(s) contained hereinafter.     • Our sole objective is to provide You with timely, efficient, high quality content and collaborative learning platforms with personalized services (Wherever required), by leveraging innovations in digital and print media and enable you to better achieve Your Learning Objectives and experience.

    • Lumos Learning adopts the practice of minimizing the use, collection, and retention of Personally identifiable information as a basic privacy principle. We are aligned to “Minimum necessary principle”, whereby, we limit PII collections to the least amount necessary to conduct our business and achieve our objectives. Lumos Learning carefully considers the total amount of PII used, collected, and maintained, as is necessary to achieve its objectives.

  • We do not collect any Sensitive Personal Data or Information, from any user of this Website. During the online registration process, We ask for your Name, and email id at the time of registration. We send log-in credentials to such registered members for a secure access to our Website. Once registered, You can access the Member Area by keying in your login id and the corresponding password.

    • 4.1 In order to become a registered member of this Website, You are required to fill and submit an online Registration Form. Through this Registration Form, We collect certain personally identifiable information from You including, but not limited to, Name, email id, login name, password.

    • 4.3 The Online programs can be purchased by the Schools, Educators or Parents. Based on the Online programs purchased, the personal information collected will include (i) school administrators’ names, contact information and Login Information, (ii) teachers’ names,, contact information and Login Information, (iii) identifying information about students provided by the school administrator or teacher or parents, for e.g. students’ names solely for the purpose of tracking and gathering data regarding such students’ use of various products of our company, (iv) parents’ names and contact information provided by the parent themselves or school administrator or teacher, solely for reference, and (v) credit card information, debit card information, PayPal information, as the case may be.

    • 4.4 We also collect usage information through technology, such as cookies, as further explained in Section 13 below.

    • 4.5 We may obtain certain information through your social media or other online accounts if they are connected to your Lumos Learning account. If you log in to our account via Google, Clever, or any other third-party platform or service, we ask for your permission to access certain information about that other account. For example, depending on the platform or service, we may collect your name, login email address, location, physical location of your access devices.

    • 4.6 Those platforms and services make information available to us through their APIs. The information we receive depends on what information you (via your privacy settings) or the platform or service decide to give us.

    • 4.7 If you access or use our Services through a third-party platform or service, or click on any third-party links, the collection, use, and sharing of your data will also be subject to the privacy policies and other agreements of that third party.

    • 4.8 We use Alexa and Google Assistant (virtual assistants) through which you may place requests and commands in your school accounts.

    • 4.9 We do not collect any other personal information about Users except when such Users specifically provide personal information on a voluntary basis (for example user name and password, login information) in connection with a request for technical support, whether by email or phone request or when personal information is provided on behalf of an individual. Personally identifiable information may also be collected from website users in the process of search queries and other support activities and may include but is not limited to log-in information, IP address, device information.

    • 4.10 We do not collect any other personal information about Users except when such Users specifically provide personal information on a voluntary basis (for example user name and password, login information) in connection with a request for technical support, whether by email or phone request or when personal information is provided on behalf of an individual. Personally identifiable information may also be collected from website users in the process of search queries and other support activities and may include but is not limited to log-in information, IP address, device information.

    • 4.11 Parents or legal guardians can also purchase the Lumos Learning Online program. If a child is below the age of 13 years, as a parent or guardian, by purchasing the program you agree that you are providing the consent to your child to use the Lumos Learning online program.

  • 5. Our Compliance with Data privacy protection Statues:

  • 5.1 We understand that Users who are under 13 years of age (“Children”) need special safeguards and privacy protection, and it is the intent of the Company to fully comply with, though not limited to, COPPA (Children’s Online Privacy Protection Act), FERPA (Family Educational Rights and Privacy Act), the California Student Online Personal Information Protection Act (SOPIPA), the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA) and all other applicable state or federal student data privacy protection laws. Company does not collect personal information directly from children online at any point. Company only receives personal information about children directly from school administrators and/or teachers or parents when they set up Student accounts. Parents or legal guardians should contact their child’s school to review any personal information regarding their children that the school’s administrators or teachers have provided to the Company.

  • 5.2 COPPA permits a school, acting in the role of “parent,” to provide required consent regarding the Personal Information of students who are under the age of 13. Where a school is a subscriber to our Products, we rely on this form of COPPA consent. We provide the school with this Policy, to ensure that the school, in providing its COPPA consent, has full information and assurance that our practices comply with COPPA.

  • 5.3 FERPA permits a school to provide educational records (including those that contain students’ Personal Information) to certain service providers without requiring the school to obtain specific parental consent. FERPA permits this where the service provider acts as a type of “school official” by performing services, for example, that would otherwise be performed by the school’s own employees. We fulfill FERPA requirements for qualifying as a school official by, among other steps, giving the school direct control with respect to the use and maintenance of the education records at issue (including associated personal information), and refraining from re-disclosing or using this Personal Information except for purposes of providing our Products to the school. We comply with FERPA by relying on this form of consent.

  • 5.4 SOPIPA permits use of student information only for educational purposes, thereby Lumos Learning is committed to protect the privacy and security of student data and thereby expressly prohibits the use of such student data for targeted advertising and selling. We fulfill SOPIPA requirements, we do not sell, share students’ data or create students’ profile from students’ data to third parties. Further we do not send any advertisements to the parents of students by using their data for non-educational purposes.

    • 6.1 Right to access your personal information:

      Upon request, we will grant you access to your personal information that you provided us, unless there is third party information, as disclosing such information shall violate their privacy rights.

    • 6.2 Right to rectify your personal data:

      6.2.1 All the personally identifiable information so collected is available for review and revision in Your Member Area. You can, at any time, review and/or change such personally identifiable information, which is incorrect or inaccurate or has turned obsolete. However, should You choose not to provide Us with the requested personally identifiable information, You understand, acknowledge and agree that You don’t have any actionable claim in this regard against the Company and the Company shall not be obligated to deliver the requested services in the absence of the provision of the requested personally identifiable information.

  • 7.1 We collect only reasonable amount of personally identifiable information in order to provide You with efficient and timely services. However, should You choose not to provide Us with the requested personally identifiable information, You understand, acknowledge and agree that You don’t have any actionable claim in this regard against the Company and the Company shall not be obligated to deliver the requested services in the absence of the provision of the requested personally identifiable information.

    7.2 We only send newsletters, latest offers, news, and updates to subscribers who opt to receive the newsletter. If You do not want Us to contact You for this purpose, You can opt-out by clicking the Unsubscribe link that is included in all Our similar emails.

    7.3 We may send certain communications to Your postal address, which are required by law to be communicated via offline mode as well.

If personal information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and take all steps required by applicable laws and regulations and our agreements with any affected Schools.

    • 9.13 Maintaining the security of your personal information also requires your cooperation and involvement. For your protection, remember to sign out of all accounts before closing your browser. There is a sign out link available on all our pages. After signing out, make sure to close all browser windows. In addition, do not use the “Remember” feature if you are signing in to your account from a computer that other persons may have access to. This is to ensure that others cannot access your personal information if you share a computer with someone else or are using a public computer.

    • 9.14 Please keep your password secure. If you have forgotten your password, you may request a new one by contacting support@lumoslearning.com. A new password will be sent to the e-mail address you specified during registration.

    • 9.15 Parents or legal guardians can request their Children’s school not to provide any personal information through their Student account to Company. Please be aware that, depending on the school’s policies, if a parent or legal guardian makes such a request, their Children may no longer be eligible to be enrolled in Company programs. Therefore, such a request by a parent or legal guardian could potentially terminate their Children’s participation in and their use of Company programs.

    • 9.16 As a parent, you understand that any personally identifiable information that your child provides in connection with registration or otherwise may be used by Us as provided in this Privacy Policy. Except where the context indicates otherwise, the remainder of this Privacy Policy (including any discussion of the personally identifiable information that we may collect, use or disclose) shall apply equally to a Child User account and an account for someone over 13.

    • 9.17 If you have any concerns about the security of your account or the security of the Service, we ask that you report your concern to us immediately at support@lumoslearning.com. While we are unable to respond to all security concerns, we appreciate your feedback and take all reported concerns seriously.

  • 10.1 We do not as a rule allow third-party operators to collect Personal Information through persistent identifiers on our Products for any purpose other than the internal operations, support, and maintenance of our Products. Further, we do not use or permit third parties to use, Personal Information collected through our Products for the purpose of targeted advertising.

  • 10.2 We may use aggregated information that does not permit the identification of any individual User or Customer for analytics purposes, to understand how our Products are accessed and used, and how they perform, so that we may improve upon their design and functionality and otherwise develop and improve upon our products and services, and to develop analytics studies.
